1. ACKNOWLEDGMENT OF RISK

I understand that physical exercise, strength training, cardiovascular exercise, weightlifting, use of exercise equipment, and other activities performed at Volt Gym involve inherent and foreseeable risks.These risks may include, but are not limited to, muscle strains, sprains, falls, collisions, equipment-related injuries, illness, serious bodily injury, permanent disability, and death. I understand that these risks may result from my own actions or inactions, the actions or inactions of others, the use or condition of exercise equipment, or other circumstances associated with physical exercise and training.

2. VOLUNTARY ASSUMPTION OF RISK

I voluntarily choose to participate in physical exercise and activities at Volt Gym.I knowingly and voluntarily assume the inherent risks associated with exercise, training, and the use of Volt Gym's exercise equipment and facilities.I understand that I am responsible for using equipment properly, exercising within my abilities and physical limitations, and requesting assistance if I do not know how to safely operate a piece of equipment.

3. 24-HOUR AND UNSTAFFED FACILITY

I understand that Volt Gym is a 24-hour access facility and that employees or staff may not be physically present at all times.I understand that immediate staff assistance or supervision may not be available while I am exercising.I voluntarily accept the risks associated with exercising in an unstaffed facility and agree to exercise responsibly and within my physical abilities.

4. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by New Jersey law, I voluntarily release and discharge Volt Gym MK Corp, doing business as Volt Gym, and its owners, officers, employees, agents, representatives, successors, and assigns from claims for personal injury or property damage arising from the inherent risks of exercise or my voluntary use of Volt Gym's exercise equipment and participation in fitness activities.

To the fullest extent permitted by New Jersey law, this release also applies to claims arising from the ordinary negligence of Volt Gym MK Corp, Volt Gym, its employees, agents, or representatives in connection with my voluntary use of exercise equipment and participation in exercise or fitness activities.

This Waiver does not release or waive liability for reckless conduct, gross negligence, willful or wanton misconduct, intentional misconduct, or any other liability that cannot lawfully be released or waived under New Jersey law.

5. EQUIPMENT USE

I understand that exercise equipment may cause injury if used improperly.I agree to inspect equipment before use to the extent reasonably possible and to stop using any equipment that appears damaged, defective, loose, or unsafe.I agree to promptly report any known damaged, defective, or unsafe equipment to Volt Gym.I will not use equipment that I do not understand how to operate safely and will seek appropriate guidance when necessary.Nothing in this section relieves Volt Gym of any duty that cannot lawfully be waived.

6. PHYSICAL CONDITION AND MEDICAL RESPONSIBILITY

I understand that Volt Gym does not provide medical advice and that participation in physical exercise may place stress on the cardiovascular, muscular, skeletal, and other systems of the body. I am responsible for determining whether I am physically capable of participating in exercise and using the facility.If I have concerns about my physical condition, health, or ability to exercise safely, I understand that I should consult an appropriate medical professional before participating.I agree to stop exercising and seek appropriate assistance if I experience symptoms that may indicate a medical problem or emergency.

7. PERSONAL PROPERTY

I understand that I am responsible for my personal belongings while at Volt Gym.To the fullest extent permitted by applicable law, Volt Gym is not responsible for lost, misplaced, stolen, or damaged personal property.

8. FACILITY RULES AND SAFETY

I agree to comply with Volt Gym's reasonable safety, equipment, access, and conduct rules.I agree not to engage in conduct that creates an unreasonable risk of injury to myself or others.I understand that failure to follow facility or safety rules may result in suspension or termination of my access to Volt Gym, subject to applicable law.

9. SECURITY CAMERAS

I understand that Volt Gym may use security cameras in appropriate areas of the facility for safety, security, access control, and facility management purposes.I understand that security cameras are not a substitute for personal responsibility, safe exercise practices, or emergency services.

10. EMERGENCIES

In the event of an emergency, I understand that I should call 911 or otherwise obtain appropriate emergency assistance.I understand that because Volt Gym may be unstaffed, a Volt Gym employee may not be immediately available to provide assistance.

11. SEVERABILITY AND NEW JERSEY LAW

This Waiver is governed by the laws of the State of New Jersey.If any provision of this Waiver is determined to be invalid or unenforceable, that provision will be limited or severed to the extent necessary, and the remaining provisions will continue in effect to the extent permitted by law.Nothing in this Waiver is intended to waive or limit any right or liability that cannot lawfully be waived or limited under New Jersey law.

12. ACKNOWLEDGMENT AND ELECTRONIC SIGNATURE

I acknowledge that I have carefully read and understand this Liability Waiver, Release of Liability & Assumption of Risk.I understand that this document affects my legal rights, including releasing certain claims arising from ordinary negligence to the extent permitted by New Jersey law.I voluntarily agree to its terms and understand that my electronic signature has the same intended effect as my signature on a paper document.
